  1. WHEN IS THIS PRIVACY NOTICE APPLICABLE?

2.1 This Privacy Notice is applicable to the processing of personal data of Users through the Website.

  1. WHO IS THE CONTROLLER OF YOUR DATA?

3.1 Life Terra is the controller with respect to the processing of your personal data as mentioned under 2.1.

  1. FOR WHAT PURPOSE DO WE PROCESS YOUR PERSONAL DATA?

4.1 For creating an account within the App

(a) What does this purpose entail?

(i) When you visit our App, you have the option to create an account. When you have an account, you can personalise your account. A benefit of having an account is that your tagged trees will be saved and linked to your account.

(b) Which personal data do we process for this purpose?

(i) For this purpose, we process the following personal data:

(A) Name; and

(B) e-mail address,

(c) For what period do we retain your personal data for this purpose?

(i) We retain personal data as long as you wish to maintain the account. You can delete your account within the App. If you have not logged in for three years , we will send you an email alert 14 days before deleting your account.

4.2 For tagging and adopting/gifting a tree.

(a) What does this purpose entail?

(i) When you visit our App, you can adopt/gift a tree and tag a tree.

(b) Which personal data do we process for this purpose?

(i) For this purpose we process personal data like:

(A) Name (optional);

(B) e-mail address;

(C) location for tagging the tree;

(D) access to phone’s storage to upload photo of the tree; and

(E) payment or credit card information.

(c) For what period do we retain your personal data for this purpose?

(i) We retain this personal data for this purpose until you delete your account. If you have not logged in for three years, we will send you an email alert 14 days before deleting your account.

4.3 For providing you with our services

(a) What does this purpose entail?

(i) When you visit our Website, there are different options of joining in. You can subscribe to a planting event or organise your own with your own resources. In this case we will use your personal data to provide you with our services.

(b) Which personal data do we process for this purpose?

(i) For this purpose we may process your:

(A) Name;

(B) your contact information;

(C) your correspondence about your service request;

(D) all other personal data you provide us with and which is required to provide our services.

(c) For what period do we retain your personal data for this purpose?

(i) Your data will be deleted from our systems after 12 months, with the exception of a log file containing your name, contact information and the date you requested our services.

4.4 For sending you information about the European Tree Planting Day by e-mail, if you have consented to this.

(a) What does this purpose entail?

(i) We would like to keep you updated on our latest events and other opportunities and developments within the European Tree Planting Day. 

(b) Which personal data do we process for this purpose?

(i) For this purpose, we process your name and your e-mail address.

(c) For what period do we retain your personal data?

(i) We retain your personal data for as long as you wish to receive information from the European Tree Planting Day initiative. In case you don’t want to receive such e-mails, you can unsubscribe at any time in your account settings or by using the unsubscribe option included in each e-mail.

4.5 For answering your questions.

(a) What does this purpose entail?

(i) On our Website you can ask us a question by email. In this case we will use your personal data to answer your question.

(b) Which personal data do we process for this purpose?

(i) For this purpose we process your email and all other personal data you provide us with and which is required to answer your question.

(c) For what period do we retain your personal data for this purpose?

(i) Your data will be deleted from our systems after 12 months, with the exception of a log file containing your name, contact information, the date you contacted us and the subject of your question.

4.6 For the technical and functional management of the App.

(a) What does this purpose entail?

(i) When you visit our App, our application administrators process technical data linked to the use of the application to enable us to deliver the functionalities of the application. With this technical data our application administrators can manage the App, for instance, by resolving technical difficulties or improving the accessibility of certain parts of the App. This way we ensure that you can (continue to) find the information on the App in a quick and simple manner. For this purpose cookies are used as well.

(b) Which personal data do we process for this purpose?

(i) For this purpose we process technical data like:

(A) The IP-address of your device;

(B) the visited webpage’s, the internet browser you use;

(C) the operating system version;

(D) the configuration of the App when utilising;

(E) the time and date of your use of the App;

(F) the duration of a visit/session; and

(G) other statistical data (aggregated and anonymous).

(c) For what period do we retain your personal data for this purpose?

(i) We will retain technical data unless an erasure request is sent to us. We will take up to 4 weeks after the request to delete your data from our systems. This data is needed for reporting purposes to the European Commission within the framework of the LIFE programme.

5.1 We use your personal data on the following basis:

(a) To comply with legal and regulatory obligations.

(b) For legitimate business purposes. Using your personal data helps us to operate and improve our foundation and minimise any disruption to the services that we may offer to you on the Website and App, such as donating. It also allows us to save your tagged trees, make our communications with you more relevant and personalised to you, and to make your experience of our products and services efficient and effective.

(c) Because you have given your consent. At times we may ask for your consent to allow us to use your personal data for one or more purposes. See the “What are your rights” section for information about the rights that you have if we process your information on the basis of your consent.

(d) For the establishment, exercise or defence of legal claims or proceedings.

(e) Because it is necessary for reasons of substantial public interest, on the basis of applicable laws.

  1. WHO HAS ACCESS TO YOUR DATA?

6.1 Life Terra, the developer of the European Tree Planting Day initiative, uses third parties for certain processing activities, such as Website hosting, our App developer, payment processing and forms platform. As far as these third parties have access to personal data in order to execute these processing activities, Life Terra has taken the required organisational and contractual measures to ensure that your personal data is exclusively processed for the purposes mentioned above. Only if Life Terra is required to do so by law, your personal data will be provided to supervisory agencies, fiscal authorities and investigative agencies.

  1. WHICH COOKIES DOES LIFE TERRA’S WEBSITE USE?

7.1 The Website and App only uses strictly necessary cookies. A cookie is a small text file that we send to your internet browser so that we are able to recognise your browser when you return. Cookies can collect data on the use of the Website such as which pages are visited and the duration of a user session. When you use the Website, the cookie sends data to Life Terra.

7.2 Life Terra does not retain a cookie longer than necessary. We use session cookies and permanent cookies:

(a) A session cookie can track usage such as the webpages you visit and what options you use. When you close the internet browser, the session is ended and the cookie is deleted.

(b) A permanent cookie enables the Website to recognize you at a subsequent visit.

7.3 Life Terra stores cookies that are essential in providing the functionalities of the Website. For instance, the cookies enable you to stay logged in as you navigate the App.

7.4 If you do not wish to receive any cookies at all, you may set your browser to refuse cookies all together. Please note that in that case you may no longer be able to use all the functionalities of the Website.

  1. HOW TO TREAT LINKS TO OTHER WEBSITES AND SOCIAL MEDIA?

8.1 On the website you will find a number of links to other websites. Although these websites are selected with care, we are not responsible for the processing of your personal data through these websites. The European Tree Planting Day Terms and Conditions and this Privacy and Cookie Notice are therefore not applicable to the use of such websites.

8.2 If you choose to share our Website through social media such as LinkedIn, Facebook and/or Twitter, your personal data (such as your name and the fact that you are interested in the European Tree Planting Day) will also be visible to all the visitors of your personal webpage on LinkedIn, Facebook and/or Twitter. With the use of such social media websites only the terms and conditions (including the privacy policy) of the social media website apply. The European Tree Planting Day or Life Terra is not responsible for the processing of personal data or the privacy policy of such social media websites. The Terms and Conditions and this Privacy and Cookie Notice are therefore not applicable to the use of such websites.

  1. MAY PERSONS BELOW THE AGE OF 16 PROVIDE PERSONAL DATA?

9.1 Persons below the age of 16 may only provide personal data to the European Tree Planting Day if they have written permission of one of their parents or their legal guardian who has read this Privacy and Cookie Notice.

  1. DO WE TRANSFER YOUR PERSONAL DATA OUTSIDE OF THE EEA

10.1 Your personal data may be processed by the European Tree Planting Day and Life Terra and Life Terra’s trusted third party suppliers, but it will not be transferred outside of the European Economic Area.

10.2 We will implement appropriate measures to ensure that your personal data remains protected and secure when it is transferred outside of your home country, in accordance with applicable data protection and privacy laws.

  1. HOW DO WE PROTECT YOUR PERSONAL DATA?

11.1 Your personal data are treated as strictly confidential Stichting Life Terra and its European Tree Planting Day initiative has taken the appropriate technical and organisational security measures against loss or unlawful processing of this data. To this purpose Amazon Web Services EMEA SARL. (Hosting provider) uses several security techniques including secure servers, firewalls and encryption, as well as physical safeguard of the locations where data are stored.

  1. WHAT ARE YOUR RIGHTS?

12.1 You may be entitled to:

(a) Ask Stichting Life Terra and the European Tree Planting Day initiative about the processing of your personal data, including to be provided with a copy of your personal data;

(b) request the correction and/or deletion of your personal data;

(c) request the restriction of the processing of your personal data, or object to that processing;

(d) withdraw your consent to the processing of your personal data (where the European Tree Planting Day is processing your personal data based on your consent);

(e) request receipt or transmission to another organisation, in a machine-readable form, of the personal data that you have provided to the European Tree Planting Day; and

(f) in certain countries, complain to your local supervisory authority if your privacy rights are violated, or if you have suffered as a result of unlawful processing of your personal data.

12.2 Where you are given the option to share your personal data with us, you can always choose not to do so.

12.3 If you object to the processing of your personal data, or if you have provided your consent to processing and you later choose to withdraw it, we will respect that choice in accordance with our legal obligations.

12.4 This could mean that we are unable to perform the actions necessary to achieve the purposes of processing described (see the “For what purpose do we process your personal data?” section) or that you are unable to make use of the services offered by us. After you have chosen to withdraw your consent or have enforced any of your rights as stated under. The European Tree Planting Day may be able to continue to process your personal data to the extent required or otherwise permitted by law, in particular in connection with Dutch tax laws.
